ANONYMITY AND PSEUDONYMY

Personal information that may be requested includes, but is not limited to, the following:

- any other personal information that you provide to us directly. When you provide us with unsolicited personal information, we keep that information as long as it is consistent with our primary purposes for collecting personal information (as set out in this Privacy Policy).

When you use a website, we may also collect personal information about you in the following general categories:

HOW DOES BEINFLUENCE COLLECT AND STORE PERSONAL INFORMATION
We only collect or control personal information about you with your consent, including as provided in this Privacy Policy or as otherwise lawful. The only personal information we collect is information that was provided or collected to us in accordance with this Privacy Policy or that was legally provided to us by third parties, including social media platforms such as Instagram and Facebook and Facebook and Twitter and Twitter and Google and Snapchat.


ACTIVE COLLECTION OF INFORMATION
Information may be collected (and combined) through our Collection Channels if you:
- have previously provided personal information to us prior to the entry into force of this Privacy Policy, either directly from you personally or through a third party;

KIDS

Persons under the age of sixteen (16) may use our websites only with the participation and consent of a parent or legal guardian.


PASSIVE INFORMATION COLLECTION
As with many commercial websites and mobile and tablet applications, we may also collect information that tells us about visitors to our websites. For example, we may collect information about the date, time, and duration of visits and which pages of a Website are most frequently visited. - for the purposes set out in the privacy statement of a particular collection channel;
- to maintain the functionality of a website, including to provide you with information relating to the content available on the website and e-commerce transactions carried out via the website;
- to fulfill the obligations relating to the download terms of use, the download, sales and purchase contract and/or any other contract between you and BeInfluence;
- to send you any technical, administrative or legal notifications that are important for our websites;
- to allow you to create an account, log in and use the functionalities of a particular collection channel, including the BeInfluence Influencer App;

- For the purposes described above, personal information may be shared with BeInfluence's promotional partners and their affiliated companies, as well as with other trusted third parties, including brands and companies using BeInfluence's services (as well as their directors, agents, and agents) in Belgium or elsewhere in the European Union. If you do not provide personal information, BeInfluence may not be able to provide you with certain content, information, upcoming opportunities, promotions, events, or products and/or to accept content and promotions participations (if applicable).
- In order to operate a website or provide a service (including, for example, credit card payment processing), personal information may also be shared with BeInfluence, selected service providers and their affiliated companies, and/or other trusted third parties in Belgium or elsewhere in the European Union. If you receive communications from BeInfluence that you do not wish to receive, you may remove your name from the database in the manner indicated in the communication, including by using the functional unsubscribe/exclusion device (if the communication is by commercial electronic message) or by contacting BeInfluence using the contact details in this Privacy Policy. Please allow 30 days for this request to be processed.
- Despite deleting your name from the database to receive future advertising and marketing information, BeInfluence may send you non-commercial “administrative emails”. Administrative letters are linked to a BeInfluence user account and may include administrative and transaction confirmations, requests and queries, or information about a particular BeInfluence user account. If you do not want to receive such communications from BeInfluence, you can remove your name from the database by using the unsubscribe function.


ABILITY OF OTHERS TO SEE INFORMATION
BeInfluence may provide areas on a website where you can upload user-generated content, post or provide information about yourself, communicate with other users, including commercial users and brands, provide reviews of content, products, and/or services, use features that allow you to post content on your own social media channels, or interact with or vote on particular content. This information may be shared with others and may be posted on our websites, including, but not limited to, other social media platforms and other public forums in which you choose to participate. This information may become available to the public and may be read, collected, and used by others on our websites or outside of our websites. BeInfluence is not responsible for the conduct of others who may read, collect, and use this information.


YOUR RIGHT OF ACCESS
- You have the right to access and rectify personal information concerning you that may be recorded in the BeInfluence database. You can exercise this right by contacting BeInfluence's Privacy Officer using the contact details in this privacy policy. Please allow 30 days for this request to be processed.
- On a case-by-case basis, BeInfluence may determine that it is not necessary to give an individual access to their personal information insofar as it is legal for BeInfluence to do so. If such a decision is made, BeInfluence will inform you in writing.
- If you require information on an electronic file, or if you wish to obtain hard copies of personal information, we reserve the right to charge reasonable handling and shipping costs.
- In the case of certain personal information that may be stored, for example when kept on program tapes, it is not practical to provide this information to you without charging an appropriate fee that we consider reasonable under these circumstances.


CHANGING AND DELETING INFORMATION WE HOLD ABOUT YOU
- It is possible to change the information in the database, or to change your preferences in contacting us, by contacting BeInfluence's Privacy Officer using the contact details in this privacy policy. The processing time for this request is 30 days.
- Similarly, a request to delete personal information may be made, and all reasonable steps to delete the information will be taken, unless required for legal reasons. Deleting information may prevent us from facilitating or providing you with information about certain transactions (including downloading, accessing, and receiving content on a website, and purchase transactions completed on a website), other content, services, or product information, information about upcoming promotions, contests, or events, and/or from providing certain content, services, or services.
- We are not responsible for removing your personal information from the lists of a third party who has previously received your information in accordance with this policy.


STORAGE AND SECURITY OF PERSONAL INFORMATION
BeInfluence strives to take all reasonable steps to secure the personal information stored, and to ensure that this information is accurate, up-to-date, complete, and relevant. We ensure that only those who are needed have access to your personal information. Personal information is stored on secure servers that are protected in controlled facilities. This service may be performed on our behalf and the data may be hosted by the data storage providers we have selected. In some cases, these installations may be located elsewhere than in Belgium, but always within the European Union.


DISCLOSURE OF PERSONAL INFORMATION TO FOREIGN RECIPIENTS
In some cases, BeInfluence may disclose your personal information to overseas recipients, including, but not limited to, recipients in New Zealand, the United States of America, the United States of America, the Philippines, and the United Kingdom. BeInfluence employees, data processors, and other trusted third parties are required to respect the confidentiality of any personal information held by BeInfluence. However, the security of Internet communications cannot be guaranteed, and therefore it is not possible to give absolute assurance that information will be secure at all times. BeInfluence cannot be held responsible for events resulting from unauthorized access to personal information.


BEINFLUENCE AND LINKS TO OTHER WEBSITES
Our websites may, from time to time, contain links to the websites of other organizations that may be of interest to you. Their inclusion cannot be considered as implying any endorsement or validation by us of the content of the third party website. SALE OF THE COMPANY
If BeInfluence merges with, or is acquired by, another company, or sells all or a portion of its assets, your personal information may be disclosed to our advisors and to the advisor of any potential purchaser, and may be among the assets transferred. ‍RIGHTS OF DATA SUBJECTS IN THE EUROPEAN UNION
- BeInfluence complies with the European Union's General Data Protection Regulation (GDPR), which comes into force on May 25, 2018. Paragraphs 40 to 49 of this privacy policy provide you with further information regarding the rights of data subjects in the European Union under the GDPR. Paragraphs 40 to 49 of this Privacy Policy should be read in the context of this Privacy Policy as a whole.
- The RGPD deals with the processing by BeInfluence of “personal data”. Purposes of the processing of personal data:
BeInfluence will process your personal data in the following way:
- BeInfluence will process the following categories of personal data that we collect from you and third parties in accordance with this privacy policy: personal information in general, in accordance with paragraph 7;
- personal information from your use of our websites, including usage and performance information, device information, and other information in accordance with paragraph 8;
- sensitive information (special category data) in accordance with paragraph 9 above. BeInfluence will process your personal data for the purposes set out in paragraph 19 above.

Recipients or categories of recipients of personal data:
- The recipients of personal data are BeInfluence and the entities set out in paragraphs 20 to 22 above.

Withdrawal of consent, or opposition or restriction to the processing of personal data:
- You can withdraw your consent at any time for the processing of your personal data, or ask us to restrict the processing of your personal data. Please note that this does not affect the legality of the processing before you withdraw your consent or request the restriction of the processing of your personal data.

Retention period of your personal data:
- BeInfluence will retain your personal data for as long as you engage in a collection channel and for a subsequent period based on our legal document retention obligations, to comply with audit and financial obligations, and with respect to personal information contained in the material that you licensed or transferred to us, for the period necessary to assert or establish our rights to that material.

Use of automated decision making:
- BeInfluence may use automated decision-making based on your social media monitoring to determine your eligibility to use certain aspects of the BeInfluence Platform.

In addition, BeInfluence can use an automated decision-making process to:
- Determine the operating region in which the service is offered to you.
- Determine from which operational region to serve you.
- Associate you with opportunities, cases or campaigns, or with participants created by other users of a collection channel.
- Investigate, prevent or take action regarding illegal activities and/or violations of the terms of use of the BeInfluence Platform.

Your rights under the GDPR:
You have a number of rights under the GDPR. These include:
- request access to your personal data;
- to request that we correct or delete your personal data;
- to withdraw your consent for us to use your personal data;
- in certain circumstances, to object to the use of your personal data by us and to request that we restrict our use of your personal data;
- receive the personal data that we hold about you, in a commonly used electronic format, or ask us to transfer this data to another service provider of your choice;
- to file a complaint relating to the processing of your personal data with a data protection supervisory authority under the GDPR; and
